Do you need to come to Spain to buy or sell your property? 

The term 'power of attorney' is commonly used in dealing with buying/selling property in Spain, but it can be difficult to ascertain what that really means. A power of attorney is not just any authorization. It is a specific authorization that allows a particular individual or company to take action on behalf of another person.

We often get asked by clients that buy properties in Spain:

"Do I need to be here in Spain all the time while you're helping me with the legal procedures?" 

The answer to this is yes and no. Legally as a law firm we're obligated to meet the client that we're representing as well as for the application to obtain a Spanish NIE number. We explain what NIE number is here.

But more than this, meaning all the legal procedures included in buying property in Spain, our clients are not required to be physically present.

What is needed though is a power of attorney provided by our client for us to be able to act in the client's name. After covid most of the things can be done online remotely which is a huge facilitation.
