THE PROVINCIAL COURT OF MALAGA DECLARES THE IRPH OF THE MORTGAGES NULL AND VOID. THOUSANDS OF PEOPLE AFFECTED COULD CLAIM AN AVERAGE OF 20,000 EUROS IN RETURN.
In its recent decision of April, 21th 2020, Section 6 of the Malaga Provincial Court has ruled in accordance with the criteria established by the Court of Justice of the European Union on March, 3rd 2020, in which the Court found in favor of the consumer, confirming that the IRPH can be subject to control of transparency by judges and courts, and therefore can be annulled and replaced by another lesser rate.
The verdict is excellent news for the Malaga citizens or foreign residents in Malaga affected, because it confirms that if there was not enough information, this rate can be declared null and void and replaced by the Euribor, plus an average differential, which normally means thousands of euros in favor of the client that the bank should return.
